PRECEDENT SETTING $424,000.00 DAMAGE VERDICT FOR DOG BITE VICTIM
Our firm made Florida legal history in the first dog-bite case in the state’s legal history in which a landlord was held liable for damages caused by a tenant’s dog occurring off the landlord’s premises. Our client Carlina Ramirez was 9 years old when she attacked in the park next door to her apartment complex by two pit-bulls owned by other tenants at the apartment complex. The landlord had a rule prohibiting pit bulls, but he did not enforce it, and Carlina became the victim of an incident that the landlord could have, and should have prevented.
The landlord contended that he had no legal liability because the incident took place next door. At first, our judge agreed, and ruled against us on the point. But on appeal, we won a reversal, because, the appeals court held, the landlord had advertised the next-door park as an amenity of the complex.
A Broward County jury returned a $424,000.00 damage award for Carlina and her mother.
